A Zimbabwean Newspaper, New Zimbabwe has reported that the application of a HIV positive wife who wanted the court to compel her husband to sleep with her was thrown away by the chief Magistrate Miriam Banda. The woman whose name was not given is a native of Domboshava, outside Harare. She informed the court that her husband has not had sex with her for the past six months.
''This is a violation of my right'' the woman emphasized. She continued, ''He is not meeting my conjugal right. When I married him, I did not chose to stay in his house eating Sadza but to enjoy sex with him''
Nevertheless, the man insisted that his wife is unfaithful. ''She went for HIV test and was tested positive; She now engages in so many sexual activities with several men. Even our child informed me of men who sometimes come to our house having sexual intercourse with her'' the husband maintained. The Chief Magistrate inquired whether they share the same bed and the man responded in the affirmative but did not make further comment. The husband denied that he was neither violent nor abusive as claimed by the wife. But rather, the wife organizes party without his knowledge, drinks her self to stupor.'' How do you expect me to have sex with her'' he questioned.
Finally, the court said they cannot force married people to have sex and advised them to file for divorce.
